These Terms of Service (“Terms”) govern your access to and use of the Dr. Franks website at drfranks.com (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About this site

The Dr. Franks Site is an informational and marketing website. It is not a medical provider, pharmacy, telehealth platform, or payment processor. The Site presents information about prescription weight-loss medications and connects interested patients to a licensed third-party telehealth and fulfillment platform operated by Hydreight (the “Hydreight Platform”), accessible at book.drfranks.com.

Any consultation, prescription, payment, or fulfillment takes place on the Hydreight Platform, which has its own terms and privacy practices. Your use of the Hydreight Platform is governed by Hydreight’s terms — not these Terms.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Site. By using the Site you represent that you meet these requirements.

3. Intellectual property

The Site — including its design, text, graphics, logos, and brand elements (collectively, “Site Content”) — is owned by Dr. Franks or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws. You may view and share Site Content for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.

4. Prohibited uses

You agree not to:

• use the Site in violation of any applicable law or regulation;

We do not control, endorse, or assume responsibility for third-party sites, content, or services. Your interactions with any third party — including any purchase, consultation, or service — are solely between you and that third party.

Our aggregate liability under these Terms will not exceed one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify and hold Dr. Franks and its affiliates harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

These Terms are governed by US federal law and the laws of the state in which Dr. Franks is organized, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in a court of competent jurisdiction in the United States.
